NITA - ELIGIBILITY AND GEOGRAPHIC SCOPE STATEMENT#
Scope version: v1 · Effective: September 20, 2026 · Supersedes: none (initial statement) · Next scheduled review: December 19, 2026
1. Statement of scope#
The Nita Sweepstakes is offered only in the State of Texas. It is not offered, and may not be entered, in any other U.S. state, in the District of Columbia, in any U.S. territory or possession, or in any other country.
This is an inclusion statement, not an exclusion list. Texas is the only jurisdiction in which Nita operates. Every other jurisdiction is outside Nita's scope by default, not by enumeration, and adding one is an affirmative, dated, published act under §6.
2. Who is eligible#
To enter the Nita Sweepstakes you must satisfy all of the following at the time of entry and at the time of any redemption.
2.1 Age#
At least 18 years old. You confirm this when you register, and your age is verified against a government-issued ID before any prize is paid (Identity Verification Policy).
2.2 Residency and ID issuing state#
Texas residency and a Texas-issued ID are not required. You must be legally eligible under the laws applicable to you, and being physically in Texas does not override a restriction that otherwise applies to you. Identity verification confirms who you are and your age; it does not establish where you live or where you are.
2.3 Physical location#
Physically located in the State of Texas whenever you place an entry, purchase, or request a redemption.
Your location is checked electronically, from the network address your device connects from, while you use the app and again before an entry is accepted, before a purchase is credited, and before a redemption is requested. If your location cannot be verified, or a VPN, proxy or similar service prevents it from being verified, the action is refused: an unresolvable location is treated as ineligible, not as permitted.
2.4 Not excluded#
You are not eligible if you are:
- an officer, director, employee, contractor or agent of Anita Inc., or of any parent, subsidiary, affiliate, advertising or promotional agency, or prize-fulfilment vendor;
- an immediate family member (spouse, domestic partner, parent, child or sibling, and their spouses) or a member of the same household as any such person, whether or not related;
- currently self-excluded or in a cool-off under the Responsible Gaming Policy (https://playnita.com/responsible-play);
- barred from the Service under the Terms of Service §11;
- listed on any government sanctions or restricted-persons list.
2.5 One account#
One account per person. See Terms of Service §3.1.
3. Non-availability everywhere else#
Nita makes no offer of any kind outside Texas. If you are outside Texas, you are not eligible to enter, whatever your citizenship, wherever your account was created, and whatever your connection to Texas. A Texas resident who is physically outside Texas is not eligible to enter or redeem while outside the state.
Attempts to appear to be in Texas when you are not - through a VPN, proxy, emulator, spoofed location, or false address - are a breach of the Terms of Service §5 and grounds for action under §11.
Nita does not maintain a list of "excluded" or "restricted" states, because it does not operate in any state other than Texas. Where you see such a list attributed to Nita, it is not ours.
4. Why Texas, and what is being relied on#
Recorded so the basis of the position is on the record and re-checkable.
- Texas has no statute addressing the dual-currency promotional sweepstakes model and, as of the effective date, no publicly reported Attorney General action against it. This is not an authorisation.
- The operative analysis is Tex. Penal Code §47.01-47.02: prize, chance and consideration. Nita removes consideration through a genuine free-entry path, which is why the Mail-In Entry Procedure is treated as a first-class compliance instrument.
- Tex. Bus. & Com. Code ch. 622 (Sweepstakes) applies only to a sweepstakes conducted through the mail other than one where the only use of the mail is a consumer returning an entry form, and only where the most valuable prize is $50,000 or more. Neither condition is met.
- Tex. Bus. & Com. Code ch. 621 (Contest and Gift Giveaway) applies to promotions used to induce attendance at a sales presentation. Nita has none.
- Texas requires no sweepstakes registration and no bond.
- Tex. Bus. & Com. Code §503.001 (CUBI) applies to the biometric identity match; Privacy Policy §7 is the notice.
- The Texas Data Privacy and Security Act is the operative consumer privacy statute; Privacy Policy §5.
5. What is not being claimed#
- Nita is not licensed by any gaming regulator, and does not hold a gaming licence in Texas or anywhere else.
- Nita is not approved, endorsed, or registered by the State of Texas, the Texas Attorney General, or the Texas Lottery Commission.
- Nita is not affiliated with, endorsed by, or sponsored by any university, college, students' association or athletic programme, including The University of Texas at Austin and Texas A&M University. Campus circles in the app are named for convenience by the Sponsor and imply no affiliation.
- Apple Inc. is not a sponsor of the Sweepstakes and is not involved in it.
- Nothing here is legal advice to any player about their own position.
6. How this document changes#
This statement is versioned. It is republished, not edited.
To add a jurisdiction, all of the following happen first:
- written analysis from gaming counsel covering that state's gambling, sweepstakes, consumer-protection, privacy and biometric law, and its current enforcement posture;
- confirmation that Nita's location controls enforce the new footprint on the server, not merely on a screen;
- any registration, bonding, or filing that state requires, completed;
- review of every published document for language that assumes a single state - the Terms of Service, Privacy Policy, Redemption Terms, Responsible Gaming Policy and Official Rules all contain Texas-specific text;
- a new version of this statement, with a new version number and effective date, published in the app and on the web before the first player in that state is admitted.
To remove a jurisdiction - because a law changes, a regulator acts, or Nita decides to withdraw - Nita will stop accepting new registrations and new entries from that state immediately; publish a new version of this statement saying so, with the date; notify affected players by email; and allow affected players to redeem Nita Cash meeting the Redemption Terms §2 conditions for at least 90 days, to the fullest extent the change in law allows (Official Rules §17.2).
Scheduled review. This statement is reviewed at least every 90 days, and immediately on any of: a new state law or bill reaching Nita's footprint, an Attorney General or regulator communication, a payment or platform provider requirement, or a material change to Nita's location controls. The review is recorded even when the outcome is no change.
Read live from the server on every view, never bundled into this page. A correction published by counsel is live here without a deploy.
